RCRA / SPCC / EPCRA Triage

A diesel AST by a creek, a listed waste drum, and an EHS above TPQ hit the same week. Sort RCRA vs SPCC vs EPCRA before you write a single plan.

Updated . Independent CSP-11 practice. Not BCSP-endorsed. No pass guarantee.

Decision rule

Environmental compliance is media-specific: air, water, waste.

A sustainability slide is not a permit.

In 20 seconds

  • Environmental compliance is media-specific: air, water, waste.
  • Triage by stuff: waste / oil / community-EHS-release.
  • RCRA: listed or characteristic; generator/accumulation/manifest.
  • SPCC: oil, threshold, discharge to waters, containment.

How to apply RCRA / SPCC / EPCRA Triage

THEORY: Trigger, limit, record, report. Each media has its own clock. CALC: Use stem-given quantities against given limits only. FIELD: New stack, no air review. Stop start-up. ASSESS: Bundling all media into ESG is the trap.

Worked case

Wrong first move: Start up and file later. Correct move: Match media, permit, and record.

Why the rule holds

Related: 29, 57, 60.

Same rule, different setting

Produced-water vs crude vs listed solvents vs an EHS cylinder. Oil-to-water is SPCC; waste is RCRA; community reporting is EPCRA.

A site diesel tank, paint-waste drums, and a chlorine cylinder for a temp disinfection skid. Same triage: oil, waste, EHS.

Picture / model

Three bins: Waste (RCRA) | Oil to water (SPCC) | Community/release (EPCRA). Arrow out of each bin: prevent first, then the plan.

Scenarios

Scenario 1 · Fundamental · CSP-11 D5.01

Spent ignitable solvent in a 55-gal drum awaiting shipment. Primary program?

Best action: RCRA hazardous-waste generator requirements.

Why: Evaluate the best response. Stormwater planning, oil-spill prevention, emergency-release notification, inventory reporting, and annual toxic-release reporting are different duties. Source reduction beats a polished filing. Use only the threshold figure the stem itself states. This item does not quo…

Scenario 2 · Applied Scenario · CSP-11 D5.01

A site stores an extremely hazardous substance above its threshold planning quantity. Which EPCRA planning requirement should it check first?

Best action: Emergency planning notification to SERC/LEPC (302/303 teaching).

Why: Evaluate the best response. Stormwater planning, oil-spill prevention, emergency-release notification, inventory reporting, and annual toxic-release reporting are different duties. Source reduction beats a polished filing. Use only the threshold figure the stem itself states. This item does not quo…

Scenario 3 · Applied Scenario · CSP-11 D5.01

Release above a reportable quantity. Best immediate compliance idea?

Best action: Report as required to the listed agencies; then prevent recurrence with a higher control.

Why: Evaluate the best response. Stormwater planning, oil-spill prevention, emergency-release notification, inventory reporting, and annual toxic-release reporting are different duties. Source reduction beats a polished filing. Use only the threshold figure the stem itself states. This item does not quo…

Check before you leave

  • ✓ Triage by stuff: waste / oil / community-EHS-release.
  • ✓ RCRA: listed or characteristic; generator/accumulation/manifest.
  • ✓ SPCC: oil, threshold, discharge to waters, containment.
  • ✓ EPCRA: planning, inventory, release reporting, TRI as asked.
  • ✓ HAZCOM is worker-facing, not community EPCRA.
  • ✓ One plan does not satisfy the other statutes.
